MA Line Up ID Process
In a Massachusetts line up there is usually 6 people that are lined up. The eye witness is placed behind a one way mirror. The police generally will try to hold a line up soon after the suspect is arrested. The police will try to put other decoys in the lineup that look similar to the suspect. If the line up in biased, the identification can be suppressed by the court. Some examples include the suspect being the only person that is a certain race, the only person that is grossly overweight, or the only person that is tall.
Each person is placed in front of a number and asked to face the mirror. The suspect will not be able to see the eye witness behind the one way mirror. The other people part of the lineup does not have to be suspects or defendants. They can be regular people can even be police officers. The police may ask the people to step forward so the eye witness can get a better look. If the eye witness can point out the suspect then a positive identification is made.
