MA Photo ID Process
During a photo ID the eye witness is given several pictures to look at. In Massachusetts, police departments have a photo ID protocol that they must follow. During a criminal case, your criminal defense attorney can request the photo array that was produced to the eye witness.
The photos that are shown in a Massachusetts photo array are usually just that of a person’s face. The police are required to put people who look similar to the suspect in the photo array. A photo array that has the suspect as the only white person will likely be rejected by the court. If the police fail to follow the procedure, the positive ID will be suppressed. Just because the ID is suppressed does not mean a dismissal of your case.
